SmutLib is a platform for fiction without limits. This page explains what we allow, what we prohibit, and the legal basis for our policies.

Our Core Principle

Fiction Is Not Reality

SmutLib hosts fictional written content created by adults, for adults. Fiction that depicts illegal, immoral, or taboo acts is not endorsement of those acts, just as a murder mystery does not endorse murder, a war novel does not endorse violence, and a heist film does not endorse theft.

Authors who write about dark, transgressive, or taboo subjects are engaging in a literary tradition as old as storytelling itself. We believe adults have the right to read and write fiction exploring any subject, without restriction.

Every story on SmutLib is a work of imagination. Characters are not real people. Events described did not happen. No person or animal was harmed in the creation of any content on this platform.

What We Allow

SmutLib permits fictional written content on any subject, including but not limited to:

Sexual content of any kind between fictional characters, including depictions of taboo relationships, non-consensual scenarios, extreme kinks, and any other sexual theme or fantasy — provided all content is entirely fictional and clearly presented as such.

Fiction depicting fictional minors in sexual situations. We recognize this is among the most controversial content we host, and we address the legal basis for this policy in detail below.

Fiction depicting bestiality, zoophilia, and other acts involving fictional animals. As with all content on this platform, these are imagined scenarios in written fiction. No real animals are involved or harmed.

Fiction depicting violence, torture, gore, snuff, and other extreme content — provided it is fictional and presented as such.

Fiction exploring any political, religious, or ideological scenario, no matter how offensive.

In short: if it is fiction and it is text, it is allowed on SmutLib.

What We Prohibit

Our content restrictions are narrow and absolute. The following content will be removed immediately and may result in account termination:

Strictly Prohibited

Real child sexual abuse material (CSAM). Any photographic, photorealistic, or AI-generated imagery depicting real minors. This is a crime everywhere in the world, and we have zero tolerance for it.

Real person identification. Content that uses the full real name and likeness of a living private individual in a sexual context without their consent.

Non-fictional content. Guides, instructions, or factual descriptions intended to facilitate real-world criminal acts.

Doxxing and harassment. Posting another person's private personal information anywhere on the platform.

Malware and spam. Links to malicious software, phishing sites, or automated spam content.

Plagiarism. Uploading another author's work as your own without permission.

Legal Framework

SmutLib operates under the jurisdiction of the Republic of Moldova, where our servers are hosted and our infrastructure is based. Moldovan law does not criminalize fictional written content, regardless of subject matter.

However, because the majority of our users and authors are based in the United States and other English-speaking countries, we provide clear legal context for those jurisdictions as well.

United States Law

Written fiction — including fiction depicting illegal acts — is protected speech under the First Amendment. The relevant legal precedents are well-established:

Ashcroft v. Free Speech Coalition, 535 U.S. 234 (2002)
Supreme Court of the United States
The Court struck down provisions of the CPPA that banned virtual or fictional depictions of minors in sexual situations. Content which does not involve real children in its production is protected expression under the First Amendment.
Miller v. California, 413 U.S. 15 (1973)
Supreme Court of the United States
Established the three-part test for obscenity. Written fiction with narrative structure, characterization, and plot development holds literary value and is virtually never found obscene under this test.
18 U.S.C. § 1466A — The PROTECT Act (2003)
Federal Statute
This statute primarily targets visual depictions, not written text. No person in the United States has ever been successfully prosecuted for purely written fiction under this or any other federal statute.

Why Fiction Is Different

Laws against child sexual abuse material, bestiality, and other criminal acts exist to protect real victims. Written fiction creates no victims.

This is the same legal principle that allows publishers to sell novels depicting murder, terrorism, torture, genocide, drug trafficking, and every other conceivable crime. Fiction is how humans process, explore, and understand the full spectrum of experience.


Frequently Asked Questions

Is it legal to write fiction involving minors in sexual situations?
In the United States, yes. The Supreme Court ruled in Ashcroft v. Free Speech Coalition (2002) that fictional content not involving real children in its production is protected under the First Amendment. In the Republic of Moldova, where SmutLib's servers are located, there is no law prohibiting fictional written content of any kind.
Could I get in legal trouble for reading or writing content on SmutLib?
If you are in the United States, reading and writing fiction is protected by the First Amendment regardless of the subject matter. No person has ever been prosecuted in the US for reading or writing text-based fiction. If you are in another country, laws vary and you should familiarize yourself with your local regulations.
Why do you allow content that many people find morally repugnant?
Because we believe that the right to imagine is absolute. Fiction has always explored the darkest aspects of human experience. We trust adults to distinguish between fiction and reality, and we refuse to impose moral judgments on the imaginations of our users.
Do you cooperate with law enforcement?
SmutLib will cooperate with Moldovan law enforcement pursuant to valid Moldovan legal process. We are not subject to the legal process of other jurisdictions. We do not voluntarily share user data with any government or organization.
How is SmutLib different from platforms that ban taboo content?
Most platforms restrict content based on moral or commercial judgments rather than legal requirements. SmutLib's content policy is based solely on law: if it's legal, it's allowed. We don't make moral judgments about fiction.

Author Responsibilities

While SmutLib provides a platform with minimal restrictions, authors are expected to:

Tag accurately. Proper tagging is the foundation of our community. Readers use tags to find content they enjoy and avoid content that disturbs them.

Mark all content as fiction. All stories must be presented as fictional works of imagination.

Respect other authors. Do not plagiarize. Do not harass other authors in comments.

Understand your local laws. SmutLib operates under Moldovan law, but you are responsible for understanding the legal requirements of your own jurisdiction.
